Here’s a short piece that asks “Should whites ever drink from a ‘whites only’ water fountain?”
Should Heterosexuals Boycott Marriage?, Issues in Legal Scholarship, Single-Sex Marriage (2004): Article 2, http://www.bepress.com/ils/iss5/art2 (with Jennifer Gerarda Brown).
Here’s an oped which in the end suggests a new mechanism for combining anonymity with disclosure
Anonymously Yours,, Worth 32 (November 2004).
Here’s an oped that that discusses the new bundling remedy for Microsoft in Europe:
Microsoft I: A Remedy Worthy of Solomon, International Herald Tribune (Oct. 11, 2004) (with Barry Nalebuff).
And in case you thought that I would never write another law review article, here are three preprints of forthcoming pieces:
Instead of testing whether sellers discriminate against buyers, this article tests whether customers discriminates against sellers: To Insure Prejudice: Racial Disparities in Taxicab Tipping, Yale Law Journal (forthcoming 2005) (with Fred Vars and Nasser Zakariya).
This article proposes a new crime to make progress on the problems of both STDs and acquaintance rape: A Separate Crime of Reckless Sex, University of Chicago Law Review (forthcoming 2005) (with Katharine Baker). The final article will include original data analysis (not included in the above link). Baker and I estimate that nearly half of all sexual pairings in the U.S. are “one night stands” – so that inducing condom use would have the effect of dropping out nearly half of the nodes in an STD network.
This article suggests an incremental strategy of Voluntary Integration for making progress within a don’t ask don’t tell regime: The Inclusive Command: Voluntary Integration of Sexual Minorities into the U.S. Military, Michigan Law Review (forthcoming, 2005) (with Jennifer Gerarda Brown).
Finally, I’ve started blogging a bit and you can find my thoughts on everything from Kobe Bryant to the Abbu Ghraib at http://balkin.blogspot.com.
